This course explores the basic legal framework of planning in Victoria. The Course will identify and analyse the legal knowledge required for planning in Victoria, including knowledge about:
the Victorian Planning Provisions and the planning scheme amendment process;

• applying for a permit;
• considering a permit application;
• reviewing or appealing a decision or seeking a declaration; and
• Ministerial call in powers.

Learning Outcomes 

• An appreciation for the interrelationships within the Victorian planning system.
  Improved understanding of:
  • difference between use and development;
  • existing use rights;
  • applying for a permit;
  • processing a planning permit application;
  • matters to be considered when making a decision on an application
  • prohibitions against granting of planning permits;
  • the operation of permit conditions;
• Gain knowledge of the difference between reviews / appeals and applications for declarations at VCAT
• Develop greater awareness for the legal context of the planning system in Victoria
