41 days at VCAT and what do you get? A planning enforcement case study

Yarra Ranges SC v Australian Native Landscapes Pty Ltd

This seminar will canvas the lessons from a protracted enforcement/cancellation proceeding in VCAT, which resulted in the cessation of green waste composting operations on land in Coldstream. Those operations had resulted in persistent foul odours up to 2km away from the site.

James Larmour-Reid, then the Director, Planning, Building & Health at the YRSC, was the ‘link’ between compliance officers and the Council’s Executive and the councillors, and was also the primary instructor to the Council’s lawyers.

Rhett English, then Compliance Officer at the YRSC, was responsible for investigating the complaints, gathering the evidence and liaising with residents and the facility operator on a day-to-day basis.

Ragu Appudurai appeared for the Council in the VCAT proceedings.

James, Rhett and Ragu will take participants through the spectrum of positives, negatives, successes, failures and lessons for effective enforcement from the ‘coal face’ to the ‘sharp end’.
